🔍 The Bruscato Brief

This Week's Question:

🏍️ Can the insurance company blame the motorcyclist even when the other driver caused the crash?

The Short Answer:

Yes. Fair or not, motorcyclists often face assumptions that they were speeding, weaving through traffic, or riding recklessly. Insurance companies know this and may try to shift a portion of the blame to the rider, even when the facts tell a different story.

Key Things to Know:

✅ Louisiana follows a comparative fault system, meaning your compensation can be reduced by your percentage of fault

✅ Insurance companies often look for ways to increase a rider's share of responsibility

✅ Evidence like witness statements, photos, video footage, and police reports can help establish what really happened

✅ Motorcycle crashes often result in more serious injuries and higher medical costs than passenger vehicle accidents

⚠️ One of the biggest mistakes riders make is accepting the insurance company's version of events before all the facts have been gathered.

➡️ Bottom Line: Motorcycle riders deserve the same fair treatment as everyone else on the road. If you've been injured in a crash, don't let assumptions or stereotypes determine the outcome of your claim.

Coach Vincent feels confident about the mindset of his Warhawks as the regular season gets underway. In year three of Vincent's tenure, ULM holds the highest player retention rate in the Sun Belt Conference.

The season begins Saturday in Starkville against Mississippi State. The home slate at FMOL Health | St. Francis Stadium is loaded this season. It features three in-state matchups, including the renewal of the I-20 Showdown with Louisiana Tech, plus a Thursday night matchup with ULL on November 12th.

Warhawk fans, it's time for football! 🏈

As the ULM Warhawks head to Starkville to kick off the season against Mississippi State, Bruscato Law has a few tips for fans making the trip east this weekend.

🚗 Give Yourself Plenty of Time
The drive from Monroe is about four hours, so plan ahead, leave a little early, and build in time for fuel, food, and stretch breaks.

📵 Stay Focused Behind the Wheel
Put the phone away, buckle up, and keep your attention where it belongs.

☀️ Be Ready for the Heat
Tailgating and early-season football can mean long hours in the sun. Pack water, sunscreen, and anything else you'll need to stay comfortable.

🚦 Expect Extra Traffic Around Campus
With thousands of fans heading to the game, roads around Starkville will be busy. Give yourself extra time and keep an eye out for pedestrians, traffic changes, and packed parking lots.

📸 Bonus Challenge for Passengers: Keep an eye out for our billboard in Tallulah and snap a photo if you spot it!

No matter where game day takes you, Bruscato Law is proud to support the Warhawks on the road and on the roadways.

Giving back to our community can take many forms, and sometimes it looks like sharing what you know with the next generation.

John Bruscato recently had the opportunity to speak with students in Neville High School’s WorkKeys Business Communication class, sharing real-world insight, professional experience and a few lessons learned along the way.

John is passionate about investing in the young people in our community and helping equip them with the knowledge and confidence they need for what comes next. And when John is the one doing the talking, it pays to pay attention. You just might get something back from the lecture, too. 👀

We’re grateful for opportunities like this to connect with local students, share what we’ve learned and invest in the next generation. 💙

🔍 The Bruscato Brief

This Week's Question:
🚗 Can you be injured in a car accident even if you felt fine afterward?

The Short Answer:
Absolutely. Some of the most common car accident injuries, especially back and neck injuries, don't show up right away. It's not unusual to feel okay at the scene and wake up a day or two later dealing with pain, stiffness, or limited movement.

Key Things to Know:

✅ Adrenaline can temporarily mask pain after a crash

✅ Common injuries include whiplash, herniated discs, sprains, and strains

✅ Delaying medical treatment can make recovery harder and give the insurance company an opportunity to question your injury

✅ Consistent treatment and documentation help protect both your health and your claim

⚠️ One of the biggest mistakes people make is assuming they're fine because they didn't hurt immediately after the crash.

➡️ Bottom Line: If you've been in an accident, it's always worth getting checked out, even if your symptoms seem minor. Some injuries take time to appear, and early medical care can make a significant difference.
