IMPORTANT NEWS FOR VEHICLE OPERATORS CARRYING OUT
INTERNATIONAL JOURNEYS
The current legislative position is that to comply with drivers’ hours rules, any HGV or PSV installed with an analogue or digital tachograph and used on international transport journeys between the UK and EU must be fitted with a smart tachograph 2 by 31 December 2024 – except where a vehicle has already been fitted with a smart tachograph 1.
For PSVs, the Department for Infrastructure (DfI) have previously advised that the drivers’ hours and tachograph rules under the AETR are now applicable. The EU will enforce AETR requirements for PSVs used on these journeys while in the EU.
DfI can now advise that the retrofit requirement will not be enforced for:
• HGVs by authorities in Northern Ireland, GB and the EU before 28 February 2025
• PSVs as the UK legislation will be amended to apply AETR rules to these vehicles when on international journeys between the UK and EU
WHAT YOU NEED TO KNOW
HGVs
To comply with drivers’ hours rules, drivers of HGVs over 3.5 tonnes being used for international journeys between the UK and EU must have a smart tachograph 2 fitted by 31 December – except where a vehicle has already been fitted with a smart tachograph 1.
DfI are still encouraging drivers to comply; however, sanctions or penalties will not be applied on the roadside before 28 February 2025 for those who have not yet undertaken the tachograph refit.
If you only carry out journeys in the UK, vehicles can still use the original analogue, digital or smart version of tachograph fitted.
