"So what you’re telling me is... if I just rev-match on a downshift and an officer deems it 'too loud', they can take the bike right there and then?"

The recent updates to Section 59 mean the old 'one free warning' is officially a thing of the past. Police now have the immediate power to seize a vehicle on the spot if they believe it's being ridden in a careless or inconsiderate way that causes "alarm, distress, or annoyance."

Don't get us wrong, this is a massive win for getting actual anti-social riders and genuine nuisances off our streets. It's exactly the kind of swift action needed to stop the groups that give all bikers a bad name, and it will genuinely make our local roads and communities much safer for everyone.

But for the everyday, law-abiding rider, it definitely sparks a bit of a debate. "Annoyance" is a pretty broad and subjective term. If you ride a bike with a slightly throatier aftermarket exhaust, or you just happen to hold a lower gear in heavy traffic, where exactly does the judgment lie?

It relies heavily on the individual officer's discretion on the day. While the vast majority of officers are simply doing their job to keep communities safe and target the real troublemakers, it’s natural for the biking community to wonder if this broad wording could occasionally catch out a legitimate rider who isn't actually trying to cause any grief.
A new amendment to section 59 the road and traffic act can allow just that....

What do you reckon? Is giving the police these immediate powers exactly what we need to clean up the streets, or is the wording a bit too much of a gray area for comfort?
🔗 Stay up to date with the laws that actually affect your ride and where the gray areas are. Read our full breakdown of the new Section 59 rules on the BeMoto blog here:
