Do you know your rights when it comes to your collision repairs and the insurance claim? Most people don't realize they can say who fixes their car, not their insurance carrier. Don't be afraid to speak up when getting your car repaired, it's your safety afterall. We highly recommend you don't send in pictures, chances are you'll get shorted on your repair cost, set up the inspection with your insurer and your preferred repair shop.
A few key points everyone should know:
In New York, insurers must conduct in-person auto repair inspections within six business days at a time and place "reasonably convenient" to the insured. While photo estimating is allowed, it cannot replace an in-person inspection if a dispute arises.
Right to Choose Shop: Insurers cannot force you to use a specific repair shop, and you have the right to select your own, as per NY Insurance Law Section 2610.
Dispute Mechanism: If an insurer fails to meet inspection timelines, they lose the right to dispute the shop’s bill, except for parts prices and labor rates.
