***ENFORCEMENT NOTICE***
On May 16th, 17th and 18th the Leander Police Department will be joining in on a regional traffic safety initiative regarding the "Move Over" law with other law enforcement agencies in the area.

While it is oftentimes easily referred to by some as the "Move Over" law, you actually have two options.

I will post the text of the actual law below in the comments, but the law requires a motorist who passes a stationary tow truck, emergency vehicle or Texas Department of Transportation (TXDOT) work truck with their lights activated to do at least one of two options:

1). Vacate the lane closest to the vehicle when driving on a highway with two or more lanes traveling in the direction of the vehicle; or

2). Slow to a speed not to exceed:
A). 20 miles per hour less than the posted speed limit when the posted speed limit is 25 miles per hour or more; or
B). Five miles per hour when the posted speed limit is less than 25 miles per hour.

If you move over to a lawfully available lane (one lane separating your vehicle and one of the vehicles listed above) you are not required by law to slow down.

If you do not have a lane you can move over to, then your only option by law is to slow 20 mph below the posted speed limit.

We have a problem with this on nearly every road in the city. On highways we consistently see folks pass us at highways speeds, even when they could move over (or at least slow down). In residential areas we often see folks go onto the wrong side of the road thinking they are "moving over", when the law actually requires you to slow down 20mph below the speed limit because there is not two lanes in the same direction to move over in to.

If you have a question just ask! We want everyone to understand this law and to follow this so we do not have to stop anyone for this violation. Failing to follow this has cost many emergency service employees, tow truck operators, roadside construction crews and even innocent motorists their lives.

We will be conducting this targeted enforcement on several roadways in the City (other agencies will be participating area wide on roadways in their jurisdiction). We will be taking a Zero Tolerance approach to enforcement of this law.
