In any speeding infraction, it is always best to present your case to the court with a speedometer calibration in hand. Call any attorney for legal advice and the first thing they will usually ask is, “have you had your speedometer checked?” In some jurisdictions, even if your speedometer is off by only 1-2 MPH, the judge may reduce the ticket to a defective equipment infraction, resulting in a non-moving violation. Non-moving violations do not usually affect your insurance premiums. In reckless driving by speed cases, as long as it’s not gross reckless driving (such as driving 120 MPH in a 65 MPH zone) just being off a little could mean the difference between being found guilty of a class 1 misdemeanor (punishable in Virginia by up to one year in jail) and a simple speeding infraction. And finally, depending on how much your speedometer is off, the court under the Code of Virginia and most other states can dismiss your ticket outright.
