What it doesn’t do (at least currently)
• The rule does not fully ban all non-citizens from obtaining or renewing CDLs; some non-citizens may still qualify if they meet the stricter criteria.
• Existing CDLs held by non-citizens are not automatically revoked; the rule is not being applied retroactively in many cases.
• The restriction is specific to non-domiciled CDLs, a term that generally means someone whose primary residence (domicile) is not in the issuing state or who lacks lawful presence under the new definition.
• The regulation is being enforced via states pausing issuance until compliance systems are in place; it’s not an across-the-board blanket ban from day one.
