Our evaluator, John Ivey, charges a $163 fee and does evaluations by appointment only. Some first offenders may be required by the court (enforced through probations) to have an evaluation, also. DUI and Commercial Driver's License changes took effect in 2024, and many CDL drivers are unaware of them. I spoke with a driver earlier this week, and he thought I was lying. The federal DOT implemented a Clearinghouse for certain alcohol and/or drug use situations. CDL drivers with a DUI lose the ability to operate a commercial vehicle; this is referred to as a downgrade by the Georgia DDS. CDL drivers can have their Class-C license reinstated 120 days after a first DUI, provided they have a DUI Risk Reduction certificate and pay a $210 reinstatement fee at the DDS customer service center.
The federal clearinghouse may require additional steps for the CDL to be cleared for return to duty. Your trucking company must have a designated representative who can assist you. Alternatively, you can visit https://clearinghouse.fmcsa.dot.gov/ to look it up yourself. There are significant fines and penalties for both the driver and the trucking company for operating a commercial vehicle while the commercial driver's license is downgraded. According to the Federal Clearinghouse website, the first step is to have the Clearinghouse status change from “prohibited” to “not prohibited.” To do this, you must complete the return-to-duty (RTD) process, as established by 49 CFR part 40, subpart O. After you complete the RTD process and your Clearinghouse status is updated to “not prohibited,” your State Driver Licensing Agency (SDLA) will allow you to reinstate your commercial driving privileges.

The FMCSA has created a resource that outlines the steps drivers take to complete their Return-to-Duty (RTD) process. Download the Return-to-Duty Quick Reference Guide. For more information about the RTD process, visit the Clearinghouse Learning Center. https://clearinghouse.fmcsa.dot.gov/.../RTD-Driver-Insert...

The Georgia DDS says:
"Drug and Alcohol Clearinghouse Status & CDL Downgrades
beginning July 1, 2024, the Georgia Department of Driver Services will begin removing the commercial driving privileges (downgrade) from the driver's license of customers that are “prohibited” until the driver completes the return-to-duty (RTD) process." https://dds.georgia.gov/

Drivers listed in the clearinghouse will need to see a provider for SAP services. I am an approved SAP provider and will be happy to help people in the clearinghouse better understand the process. John Ivey, BS AS, NCAC II, SAP 478-274-8986 [email protected]
