Have you ever had an insurance company tell you that if you choose Action Auto Body instead of one of their preferred repair shops, they won't guarantee the repairs, and you may have to pay part of the repair costs out of pocket?

If so, it's important to know the facts. As the vehicle owner, you have the legal right to choose the collision repair facility you trust. Insurance companies cannot require you to use a specific shop. In addition, the repair warranty comes from the collision repair facility performing the work, not the insurance company. At Action, we stand behind every repair with a warranty for as long as you own your vehicle. Insurance companies do not repair vehicles, employ our technicians, or apply the paint; therefore, they are not the party guaranteeing the quality of the repair. Statements suggesting otherwise may be an attempt to steer customers toward a shop that participates in the insurance company's preferred repair program. Choosing Action does not change your policy benefits and, does not result in any additional out-of-pocket expense beyond your deductible.

At Action Auto Body, we also use quality replacement parts that are backed by their respective manufacturers' warranties, providing additional protection long after the repair is completed. Our refinishing process utilizes premium Sikkens paint products, one of the most trusted paint systems in the collision repair industry. When applied according to the manufacturer's specifications, Sikkens products are covered by a limited lifetime warranty against defects in materials and workmanship. During the repair process, you may also hear the term "supplement." A supplement is simply an additional request submitted to the insurance company when hidden damage is discovered after the vehicle is disassembled. This is a normal part of the repair process and helps ensure that all accident-related damage is properly repaired. Supplements are negotiated directly between the repair facility and the insurance company and generally do not create additional costs for the customer. Our goal is to restore your vehicle safely, correctly, and in accordance with industry standards—while keeping you informed every step of the way.

Your Car. Your Choice. A MUST-READ!!!

After an accident, most vehicle owners assume they must follow the insurance company's recommendations on where to repair their vehicle. The truth is simple:

You have the LEGAL RIGHT TO CHOOSE THE REPAIR SHOP that repairs YOUR vehicle.

Insurance companies may provide a list of preferred or direct repair facilities, but the final decision belongs to you—not the insurance company.

Understanding the Difference
Insurance companies are responsible for paying covered damages under the terms of the policy. Collision repair facilities are responsible for repairing vehicles properly and safely, in accordance with manufacturer specifications and industry standards.

These are two very different responsibilities.
A repair facility's obligation is to restore your vehicle to its pre-loss condition. That means following proper repair procedures, using the correct parts when required, performing necessary calibrations, and ensuring all safety systems function as designed.

The insurance company's obligation is to evaluate and pay the claim in accordance with the policy.

Why Insurance Companies Recommend Certain Shops
Many insurance companies operate Direct Repair Programs (DRPs), which are networks of shops that agree to specific administrative processes and insurer guidelines.

While many DRP shops perform quality repairs, consumers should understand that a recommendation from an insurance company does not mean it is the only qualified repair facility available. Nor does it mean you are required to use that shop.

You are free to choose the repair facility you trust, regardless of whether it participates in an insurance company's preferred network.

The Myth of "Extra Out-of-Pocket Costs"
One of the most common concerns consumers hear is:

"If you choose a different shop, you may have to pay the difference."

This statement often creates unnecessary fear and confusion.

In reality, hidden damage is frequently discovered after repairs begin. Modern vehicles contain advanced materials, sensors, cameras, radar systems, and structural components that cannot always be fully inspected until disassembly occurs.

When additional damage is found, the repair facility submits documentation and supplemental estimates to the insurance company. This is a normal part of the repair process and occurs every day throughout the collision repair industry.

A difference between the insurance company's initial estimate and the repair facility's final repair plan does not automatically mean the customer owes money.

Consumers should always ask for a clear explanation of any charge that is not being covered and why. Transparency is important, and reputable repair facilities are willing to explain every step of the process.

Vehicle Technology Has Changed
Today's vehicles are far more complex than vehicles built even ten years ago.

Modern repairs may require:
Advanced driver assistance system (ADAS) calibrations
Blind-spot monitoring calibration
Lane departure and collision avoidance system calibration
Manufacturer-required repair procedures
Specialized welding and structural repair techniques
Pre- and post-repair scanning
Safety system verification

These procedures are not optional. They are often required to ensure the vehicle performs as designed in the event of another collision.

Consumers deserve repairs based on safety and proper procedures—not simply the lowest estimate.

Ask Questions. Know Your Rights.
Before authorizing repairs, ask:

Am I free to choose my repair facility?
Is the repair shop following manufacturer repair procedures?
Will safety systems be inspected and calibrated when required?
Have all necessary repairs been documented?
Can the shop explain any supplements submitted to the insurance company?

An informed consumer is an empowered consumer.

The Bottom Line
When it comes to repairing your vehicle after an accident, the choice is yours.

Choose a shop based on trust, reputation, training, equipment, and repair quality—not pressure from an insurance company.

Your vehicle protects you and your family every day. You deserve the confidence of knowing it was repaired correctly.

Your Car. Your Choice. Your Safety.

YOUR RIGHTS AND OPTIONS:
Often, the insurance companies have the final decision in matters we feel are not ethical, legal, professional, or of the best quality. Many consumers want to avoid the added expense of hiring an attorney to research the terms of an insurance policy or the rights of a claimant or insured. That is why it is important to remember that the services provided to the consumer are free of charge by the Iowa Insurance Division (hereafter “the IID”).
How can the IID help? On an annual basis, IID receives some 4,500 queries and consumer complaints, often leading to investigations on insurance claims.
By educating the consumer and guiding them to resources such as the IID, they will learn their legal rights and understand the terms within their policy in greater detail. By sharing this information, the IID will see a greater increase in complaints in the future and seek more disciplinary action against the insurance companies in question. Working with the collision repair shop and the IID will guide insurance companies in allowing the repair shops to complete a quality repair with a proper warranty, versus what some consider economical or cheap collision repairs.

How can you file a complaint and have your claim investigated? Whether you are the insured or the claimant having a conflict with the insurance company’s claim and their estimate, it is easy. First, we recommend calling the IID at 515.654.6600 and addressing your concerns and questions with the Consumer Affairs Bureau (hereafter “the Bureau”). The Bureau can sometimes answer questions about your policy, such as whether you are the insured in the accident, your claimant rights, and what the Iowa Law enforces.

Often, the Bureau will recommend that a formal complaint be completed and sent to their attention for an investigation. The link to get started is https://iid.iowa.gov/consumers/filing-complaints
Please read all the way through and provide as many details as possible regarding your complaint and whether you are the insured or the claimant.
