The Supreme Court just fundamentally changed the freight brokerage risk landscape.

In a unanimous 9-0 decision, SCOTUS ruled that negligent hiring claims against brokers are NOT preempted under the FAAAA. The Court held that requiring brokers to exercise reasonable care in selecting carriers “concerns” motor vehicles and therefore falls within the safety exception.

Most important line in the opinion:

“Some carriers are known to be less safe; some truck drivers are known to be unfit.” — Justice Kavanaugh

This is the clearest signal yet that carrier-level vetting alone is no longer enough.

The industry is moving toward:
• Driver-level vetting
• Identity verification
• Behavioral risk monitoring
• Continuous compliance intelligence

The old model was: “Is the carrier authorized?”
The new model is: “Who is actually behind the wheel?”
This ruling will accelerate that shift fast.
