CS/114/2023 with IA No: 1 and 2 of 2023 (Kanishk Sinha Vs Dr Saumitra Mohan, Secretary, Director and all the registering authorities of the State of West Bengal) - The High Court while returning the plaint granted leave to file mediation notice u/s 12A of the Commercial Courts Act, 2015 claiming damages of Rs 1000 crores quantifying damages @ the rate of Rs 10000/- per eco friendly battery operated vehicles for which plaintiff holds the patent. The Hon'ble Court also observed that some registrations were granted in violation of order of injunction passed by the High Court in CS No: 388 of 2014 and Learned Alipore Court on 18-05-2023. Accordingly the Hon'ble Court directed to serve advance notice under sub section 1 of section 80 of the Code of Civil Procedure and granted leave to refile the same.

2023 के आईए संख्या: 1 और 2 के साथ सीएस/114/2023 (कनिष्क सिन्हा बनाम डॉ. सौमित्र मोहन, सचिव, निदेशक और पश्चिम बंगाल राज्य के सभी पंजीकरण प्राधिकारी) - उच्च न्यायालय ने वाद वापस करते हुए मध्यस्थता दायर करने की अनुमति दी वाणिज्यिक न्यायालय अधिनियम, 2015 की धारा 12ए के तहत नोटिस, जिसमें 1000 करोड़ रुपये के नुकसान का दावा किया गया है, जिसमें 10000/- रुपये प्रति पर्यावरण अनुकूल बैटरी चालित वाहनों की दर से नुकसान की मात्रा निर्धारित की गई है, जिसके लिए वादी के पास पेटेंट है। माननीय न्यायालय ने यह भी देखा कि कुछ पंजीकरण 2014 के सीएस नंबर: 388 और 18-05-2023 को उच्च न्यायालय द्वारा पारित निषेधाज्ञा के आदेश के उल्लंघन में दिए गए थे। तदनुसार, माननीय न्यायालय ने सिविल प्रक्रिया संहिता की धारा 80 की उपधारा 1 के तहत अग्रिम नोटिस देने का निर्देश दिया और इसे फिर से दाखिल करने की अनुमति दी।

2023 সালের IA নং: 1 এবং 2 সহ CS/114/2023 (কনিষ্ক সিনহা বনাম ডাঃ সৌমিত্র মোহন, সেক্রেটারি, ডিরেক্টর এবং পশ্চিমবঙ্গ রাজ্যের সমস্ত নিবন্ধনকারী কর্তৃপক্ষ) - হাইকোর্ট বাদীকে ফেরত দেওয়ার সময় মধ্যস্থতা করার অনুমতি দিয়েছে বাণিজ্যিক আদালত আইন, 2015 এর 12A এর অধীন 1000 কোটি টাকার ক্ষয়ক্ষতি দাবি করে প্রতি পরিবেশ বান্ধব ব্যাটারি চালিত যান প্রতি 10000/- হারে ক্ষতিপূরণ দাবি করে যার জন্য বাদীর পেটেন্ট রয়েছে৷ মাননীয় আদালত আরও পর্যবেক্ষণ করেছে যে 2014 সালের CS নং: 388 এবং 18-05-2023 তারিখে আলিপুর আদালতে হাইকোর্টের দেওয়া নিষেধাজ্ঞার আদেশ লঙ্ঘন করে কিছু রেজিস্ট্রেশন মঞ্জুর করা হয়েছিল। তদনুসারে মাননীয় আদালত দেওয়ানী কার্যবিধির ধারা 80 এর উপধারা 1 এর অধীনে অগ্রিম নোটিশ প্রদানের নির্দেশ দিয়েছেন এবং এটি পুনরায় ফাইল করার জন্য ছুটি মঞ্জুর করেছেন।
