There seems to be a whole bunch of myths, and popular beliefs surrounding certain rules in various aspects of driving and drivers hours. So, we will be posting some of these myths and explaining them. Your feedback and comments would be appreciated.
First up.. Van drivers..
There are no drivers’ hours rules for van drivers.
Many van drivers believe they operate outside drivers’ hours rules, but this is wrong. While the EU drivers’ hours regulations apply primarily to vehicles over 3.5 tonnes, drivers of vans under 3.5 tonnes are still subject to both GB Domestic Drivers’ Hours and the Working Time Regulations 1998, which limit working hours and require rest periods.
Drivers must not drive for more than ten hours in any one day and must not be on duty for more than 11 hours in any one day. Additionally, some van operations, such as those carrying certain goods or operating under specific licences, may fall under additional rules. Employers must assess which regulations apply to their drivers and ensure compliance.
Ignorance of the rules is not a legal defence, and both drivers and employers can face prosecution.
