What are the Auto-Enrolment duties if you are a sole director? Or the only other people that are working for you are directors? This query is coming up a lot. If you are a sole director then you are exempt from the duties but you must inform the Pensions Regulator. However, if there is more than one director and two or more of them have a contract of employment, then you must comply with Auto-Enrolment.

If you are an employer of a small business and not sure when you need to comply with Auto Enrolment by (known as your staging date), then you will find the attached link helpful: http://www.thepensionsregulator.gov.uk/employers/staging-date.aspx

Your staging date is set in law as of 1 April 2012 and is the date your automatic enrolment duties come into effect for you. You must be prepared for this date. You'll need your PAYE reference to find out your staging date.

Why is Auto Enrolment happening?

It has been apparent for many years that there are millions of workers who are not saving enough to provide the income in retirement that will meet their aspirations. Too many people are relying on the state pension and as we have recently seen, the date when people can take their state pension is being pushed further and further back. Different governments have tried different solutions to this problem and the previous administration came up with the idea of compulsory pensions for workers whereby contributions are automatically deducted from your salary and put into a pensions plan which is earmarked as your “pot” to be transferred from employer to employer as you move jobs.
